Ecomora Technologies Private Limited, operating the platform pi-square (hereafter referred to as “the Platform”), provides an open and connected commerce environment facilitating direct transactions between customers and business owners. The Platform itself is not a party to these transactions. Please review these terms and conditions carefully before using the Platform.
1. Definitions
• Platform: Refers to pi-square and its associated websites and mobile application operated by Ecomora Technologies Private Limited.
• Customer: Individuals engaging with businesses to purchase goods or services on the platform.
• Business Owner: Individuals or entities offering goods or services on the platform for sale or hire.
2. General Terms
• By using the Platform, all customers and business owners agree to conduct transactions in accordance with Indian laws.
• Users are expected to adhere to fair practices and maintain mutual respect while engaging on the Platform.
3. Business Owner Obligations
1. Legality of Offerings
• Business owners may only offer goods or services permitted under Indian law.
2. Service Fulfillment
• Business owners must ensure timely and acceptable delivery or performance of their goods or services.
3. Replacement, Refund & Cancellation
• In case of damaged goods or unfulfilled services, the business owner must offer a replacement, refund, or resolve the issue to the customer’s satisfaction.
• Business owners cannot charge customers for damages caused during delivery or service execution.
• Business owners have the discretion to honor any order cancellation request. Upon cancellation they need to refund any money paid by the customer.
• In cases where business owners need to refund any customer payment, they should process the refund the payment within 7 days of return or cancellation.
• Business owners can set their own replacement, refund and cancellation policies, as long as they are more favorable to customers than above mentioned points.
4. Clear Communication
• Business owners must transparently outline terms, including payment, refund, cancellation, and return policies.
• Accurate descriptions of offerings, including specifications, guarantees, or warranties, must be provided.
5. Fair Practices
Business owners must:
• Provide truthful listings and fulfill orders as promised.
• Avoid offering counterfeit or prohibited goods or services.
• Treat customers respectfully and address inquiries or disputes promptly.
4. Customer Obligations
1. Informed Decisions
Customers must review all terms, policies, and descriptions before engaging with a business owner. Customers must engage in a transaction only if they trust the business owner and agree to their stated terms.
2. Timely Payments
Customers are required to pay promptly per the terms set by the business owner.
3. No Malicious Disputes
Customers must not raise false disputes or attempt to withhold legitimate payments.
4. Accurate Information
Delivery details and other information provided by customers must be accurate and up-to-date.
5. Respectful Communication
Customers must maintain respectful and professional conduct while interacting with business owners.
6. Inspection and Reporting Issues
Customers should inspect goods or services upon receipt and immediately notify the business owner of any issues with supporting evidence.
5. Platform Role and Liability
• The Platform facilitates transactions but does not guarantee the quality, legality, or fulfillment of goods or services offered.
• The Platform is not liable for any financial or material loss incurred during transactions.
6. Platform Rights
1. Modifications and Updates
The Platform reserves the right to update features, tools, and services for better functionality and compliance.
2. Service Availability
Access to the Platform may be temporarily suspended for maintenance or updates, with prior notification where feasible.
3. Platform Monitoring
The Platform may monitor activities for compliance but is not obligated to oversee all transactions.
4. Fees
The Platform may introduce or revise fees for its services, with clear prior communication.
7. Enforcement and Penalties
1. Prohibited Activities
Engaging in illegal or unfair practices may result in account suspension or permanent bans.
2. Account Termination
The Platform reserves the right to restrict or remove accounts violating these terms.
8. Dispute Resolution
• Customers and business owners are encouraged to resolve disputes directly.
• The Platform may assist in mediation but is not obligated to provide resolutions.
9. Modifications to these Terms & Conditions
The Platform reserves the right to update these terms. Continued use of the Platform after notification of changes constitutes acceptance.
10. Governing Law
These terms and conditions are governed by Indian law, and disputes shall be resolved under the jurisdiction of Indian courts.
